How to Ensure Your Medical Practice is Compliant with Stark Law

Before signing a lease or negotiating a commercial real estate agreement, physicians should be familiar with the laws associated with their facility. One of the most important laws to consider is Stark Law. Under this law, physicians are not permitted to refer medicare or medicaid patients to another medical practice from which they can benefit financially. Specifically if the owner of a building is employed by the hospital tenant that occupies the same building, then the lease, among other items such as equipment, must be in compliance with Stark Law and Anti-Kickback Statutes. Each entity that is required to comply has different internal policies that they implement to remain compliant.
